These Terms of Service (“Terms”) govern your access to and use of Vibsocial, including the website at vibsocial.net and its content-management, scheduling, publishing, analytics, and AI-assisted features.

By creating an account or using Vibsocial, you agree to these Terms.

1. Service provider

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter into a binding agreement to use Vibsocial.

You must provide accurate registration information and keep it updated. You are responsible for:

• Protecting your login credentials
• Activities performed through your account
• Ensuring authorised users use the service appropriately
• Maintaining the security of connected social media accounts
• Promptly notifying us about suspected unauthorised access

If you use Vibsocial for an organisation, you confirm that you have authority to accept these Terms on its behalf.

3. The Vibsocial service

Vibsocial may allow users to:

• Create and organise social media content
• Upload and store media
• Generate or edit content with AI-assisted tools
• Connect supported social media accounts
• Schedule or publish posts
• Review publishing status and available analytics
• Collaborate with team members

Features may vary according to your plan, location, connected platform, API permissions, and third-party-platform availability.

4. Connected social media platforms

To use publishing features, you must authorise Vibsocial through the official login and permission process of the relevant social media platform.

You authorise Vibsocial to perform only those actions you initiate or configure, such as uploading, scheduling, saving as a draft, or publishing content.

You confirm that:

• You own or are authorised to manage every connected account.
• You will comply with each platform’s terms, policies, and community guidelines.
• You will not use Vibsocial to bypass platform restrictions.
• You understand that third-party platforms control their own APIs, approvals, limits, and availability.

TikTok, Meta, LinkedIn, YouTube, X, and other supported platforms are independent third parties. Vibsocial is not endorsed by or responsible for these platforms unless expressly stated.

A platform may reject, delay, remove, restrict, or modify a post. Vibsocial does not guarantee that scheduled or submitted content will be published successfully.

5. Your content

You retain ownership of content you submit to Vibsocial.

You grant Vibsocial a limited, non-exclusive, worldwide licence to host, copy, process, modify for technical formatting, and transmit your content solely as necessary to operate and provide the service.

You represent that:

• You own the content or have all required permissions.
• The content does not infringe intellectual-property, privacy, publicity, or other rights.
• You have the necessary consent to use images, voices, personal data, music, trademarks, or likenesses appearing in the content.
• Publishing the content does not violate applicable law or platform rules.

This licence ends when the content is deleted, except where temporary backup retention or legal obligations apply.

6. AI-generated content

AI-assisted outputs may be inaccurate, incomplete, unsuitable, or similar to content generated for other users. You must review and approve all output before using or publishing it.

Vibsocial does not guarantee that AI-generated content is accurate, original, non-infringing, legally compliant, or suitable for a particular purpose.

You are responsible for:

• Fact-checking generated content
• Reviewing intellectual-property and advertising implications
• Obtaining necessary permissions
• Following platform labelling requirements
• Disclosing AI-generated or manipulated content where required by law
• Ensuring that content does not mislead or impersonate others

Do not rely on Vibsocial-generated content as legal, financial, medical, or other professional advice.

7. Acceptable use

You may not use Vibsocial to:

• Publish unlawful, fraudulent, deceptive, defamatory, or infringing content
• Send spam or conduct unauthorised automated posting
• Harass, threaten, exploit, or impersonate another person
• Spread malware or malicious links
• Manipulate engagement or platform metrics
• Publish content that violates a connected platform’s policies
• Collect or process personal data without a lawful basis
• Upload confidential information you are not authorised to use
• Attempt to access another user’s account or data
• Probe, disrupt, overload, reverse engineer, or circumvent the service
• Resell or sublicense the service unless expressly authorised
• Use the service to train competing systems without written permission
• Violate sanctions, export-control rules, or other applicable law

We may remove content, restrict functionality, suspend accounts, or report conduct where reasonably necessary to protect users, third parties, Vibsocial, or the public.

8. Plans, payments, and renewals

Some features require a paid subscription. Prices, billing periods, usage limits, taxes, and included features are shown when you subscribe.

Unless stated otherwise:

• Subscriptions renew automatically at the end of each billing period.
• You authorise us or our payment provider to charge the applicable fees.
• Fees are payable in advance.
• You are responsible for applicable taxes.
• Failure to pay may result in restricted access or suspension.

You can cancel renewal through your account settings before the next billing date. Cancellation normally takes effect at the end of the current paid period.

Payments are non-refundable except where required by law or expressly stated in the applicable refund policy. Mandatory consumer rights are not excluded.

9. Trials and promotions

Trials, credits, and promotional plans may have separate limits or conditions. We may modify or withdraw a promotion where permitted by law.

Unless you cancel before a paid trial converts, your selected payment method may be charged according to the terms displayed when you started the trial.

10. Availability and changes

We aim to provide a reliable service, but Vibsocial is provided on an “as available” basis.

We do not guarantee uninterrupted operation or successful publication at a particular time. Availability can be affected by maintenance, network problems, third-party APIs, platform reviews, rate limits, account restrictions, or events outside our reasonable control.

We may add, change, suspend, or discontinue features. Where a material change negatively affects an active paid subscription, we will provide reasonable notice when practicable.

11. Beta features

Features identified as beta, preview, experimental, or early access may be incomplete or changed without notice. You use these features at your own risk, and they may be subject to additional limitations.

12. Intellectual property

Vibsocial and its software, interface, branding, documentation, templates, and underlying technology are owned by us or our licensors.

These Terms grant you a limited, non-exclusive, non-transferable, and revocable right to use the service during your subscription. They do not transfer ownership of Vibsocial intellectual property to you.

Feedback you voluntarily provide may be used to improve Vibsocial without restriction or compensation, provided we do not publicly identify you without permission.

13. Confidentiality

If you receive non-public information about Vibsocial, you must protect it using reasonable care and use it only in connection with the service.

We will handle your non-public content in accordance with our Privacy Policy, applicable data-protection law, and any separate data-processing agreement.

14. Suspension and termination

You may stop using Vibsocial or request account deletion at any time.

We may suspend or terminate access if:

• You materially breach these Terms
• Payment remains overdue
• Your activity creates security or legal risk
• A third-party platform requires us to restrict an integration
• Your use threatens the service or other users
• We are legally required to do so

Where reasonable, we will notify you and allow an opportunity to correct the issue. Immediate action may be taken in cases involving security, abuse, illegality, or serious platform violations.

15. Disclaimers

To the maximum extent permitted by law, Vibsocial is provided without warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, or successful publication.

We are not responsible for:

• Third-party platform downtime, changes, or account restrictions
• Deleted, rejected, delayed, duplicated, or incorrectly formatted posts
• Actions performed using compromised user credentials
• Content created, approved, scheduled, or published by users
• Business losses resulting from reliance on analytics or AI-generated output

Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

16. Limitation of liability

To the maximum extent permitted by law, Vibsocial will not be liable for indirect, incidental, special, punitive, or consequential loss, including lost profits, revenue, goodwill, opportunities, or data.

Our aggregate liability arising from the service will not exceed the amount you paid to Vibsocial during the 12 months preceding the event giving rise to the claim.

These limitations do not apply where liability cannot legally be limited, including liability arising from intentional misconduct or other mandatory statutory obligations.

17. Indemnification

If you use Vibsocial on behalf of a business, you agree to indemnify Vibsocial against third-party claims, losses, and reasonable costs resulting from:

• Your content
• Your connected accounts
• Your violation of these Terms or applicable law
• Your infringement of another person’s rights
• Your misuse of the service

This provision applies only to the extent permitted by law.

18. Privacy

Our processing of personal data is described in the Vibsocial Privacy Policy. If you process personal data belonging to other people through Vibsocial, you are responsible for having an appropriate legal basis and providing required notices.

Where Vibsocial processes personal data on behalf of a business customer, additional data-processing terms may apply.

19. Governing law and disputes

These Terms are governed by the laws of Finland, excluding conflict-of-law principles.

Disputes should first be raised with us at [Legal or support email] so the parties can attempt to resolve them informally.

If the dispute cannot be resolved, it will be submitted to the competent courts of Finland, unless mandatory consumer-protection law gives an individual consumer the right to bring proceedings elsewhere.

Finnish consumers may also contact the Consumer Advisory Services and submit qualifying disputes to the Finnish Consumer Disputes Board.

20. Changes to these Terms

We may update these Terms to reflect service, legal, security, or operational changes. Updated Terms will be posted with a new effective date.

For material changes, we will provide reasonable advance notice where practicable. Continuing to use Vibsocial after the effective date constitutes acceptance of the revised Terms, except where additional consent is legally required.

21. General provisions

If any provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver.

You may not transfer your rights or obligations without our consent. We may transfer these Terms as part of a merger, acquisition, corporate restructuring, or sale of the service, subject to applicable law.

These Terms, the Privacy Policy, plan details, and any applicable supplementary agreement form the complete agreement concerning your use of Vibsocial.
